Can the director transfer the position of head of the office to any teacher?

I am a high-category chemistry teacher. Since there was a laboratory room at the school, I wanted to take the position of head of the office.

But our director said that we would assign the position of head of the office to another teacher, not to you. That teacher's rank is no higher than mine. Is this true? Can the director entrust the position of head of the classroom to any teacher?

As is known, according to Article 116 of the Labor Code, with the employee's consent, during the established duration of the working day (shift), in addition to the main work stipulated by the employment contract, they may be assigned, for an additional fee, to perform additional work at the same employer in the same profession (position) or in another profession (position) as at their main job.

As you know, on August 30, 2024, in accordance with Order No. 288, signed in agreement with the Ministry of Preschool and School Education, the Ministry of Economy and Finance, and the Ministry of Poverty Reduction and Employment, the position of laboratory assistant in schools was completely abolished.

With this order, it was established that one physics and chemistry teacher, if laboratory rooms are available, will receive a monthly additional payment for office management in the amount of 50% of the minimum wage.

Also, in accordance with the Resolution of the President of the Republic of Uzbekistan dated September 30, 2024, No. PP-346, paragraph 10 of the Regulation "On Remuneration of Public Education Employees," approved by the Resolution of the Cabinet of Ministers dated December 21, 2005, No. 275, is supplemented by subparagraph "g," according to which, if there is a laboratory room, one of the physics or chemistry teachers receives a 50 percent additional payment.

However, no special requirements have been established for the position of head of the classroom, and the above-mentioned legislative acts provide for the assignment of the position of head of the classroom to one of the physics or chemistry teachers.

That is, a norm has not been developed that gives priority in assigning the position of head of the office to teachers. Therefore, the position of head of the office can be assigned to any of the teachers at the employer's request.
