Can some teachers be deprived of a 70% bonus?

Clause 48 of the Regulation, approved by the Resolution of the Cabinet of Ministers No. 572 dated September 17, 2021, provides for the establishment of an additional 70 percent allowance to the base tariff rates of teachers who participated in the certification and received a score of 86 or higher.

According to paragraph 47 of this Regulation, within one month after the completion of the certification process, the relevant order (decision) of the Ministry approves the list of teaching staff who have been awarded the highest, first, and second qualification categories based on the results of the certification, and based on the list, electronic certificates with a QR code are generated online through the platform.

In this case, the official website of the ministry will be integrated with the UzASBO program and school management (ERP) programs for the automatic calculation of changes made to the monthly salaries of teaching staff whose qualification category (position) has been increased or maintained based on the results of regular, mandatory, and extraordinary certification, as well as those whose qualification category (position) has been reduced based on the results of regular mandatory certification.

The amount of basic tariff rates of teaching staff, their qualification category or position are determined on the basis of the certificate, and their salaries are recalculated from the date of certificate generation.

Thus, a total of 4,198 teachers who received a qualification certificate with a result of 86 points in the spring attestation, who have a higher and first qualification category, are paid 70 percent bonuses from the date of receipt of the certificate.

Will those who participated in the autumn certification be deprived of a 70% bonus?

As is known, the results of the qualification category (test) tests held these days are also considered as the first stage of the "Teacher of the Year" competition - the qualifying test.

Therefore, 4,198 teachers who participated in the spring attestation and received a 70% bonus may also be participating in the autumn extraordinary attestation to apply for the "Teacher of the Year" competition.

If teachers who participated in the spring attestation and received the first qualification category and a 70% bonus also participated in the autumn attestation and received the highest qualification category, but did not achieve a result of 86 points, then they may be deprived of the 70% bonus.

Won't the bonus be paid for two years?

True, the validity period of the 70% bonus was two years, and only after the expiration of the period were teachers required to participate in the tests for the bonus again.

However, there is one small aspect that should be taken into account in the current regulatory documents. As is known, paragraph 3v of the Decree of the President of the Republic of Uzbekistan dated May 26, 2023 No. UP-79 provides for additional payment to pedagogical personnel who have received a qualification certificate based on international standards in the amount of 70 percent of the current amounts of tariff rates.

That is, teachers currently receiving a 70% bonus are paid this bonus in relation to the current amounts of their tariff rates.

If a teacher achieves a 70% bonus with the first qualification category and participates in the autumn attestation, for example, passes to the highest category with 80-84 points, then it will be impossible to pay them a 70% bonus.

Because in this situation, its current tariff rate is changing. That is, it will be impossible to pay a 70 percent bonus to a teacher with the highest category during the period of the first qualification category.

Of course, this is a shortcoming in the legislation. In fact, in such cases, it is advisable to apply the norm established in Article 20 of the Constitution of the Republic of Uzbekistan to pedagogical workers.

That is, all contradictions and ambiguities in the legislation in the relationship between a person and state bodies should be interpreted in favor of human interests.

From this point of view, we believe that in this case, the proceedings should be carried out on the basis of the same principle. According to Xalqtaliminfo.uz, the Ministry of Preschool and School Education is currently negotiating with the Ministry of Economy and Finance to resolve this issue.
