Reimbursement of the money paid to teachers as a bonus is against the law

This year, financial inspections were carried out in some districts of the Fergana region, and the payment of teachers' allowances from the director's fund in June-August was recognized as a financial error, and teachers were tried to collect the money in violation of Article 269 of the Labor Code.
At the same time, similar cases are observed in the city of Shakhrisabz, Kashkadarya region. According to some educators told khalktaliminfo.uz, since 2021, teachers have been withheld monthly from their monthly salary the 3-year allowance paid in June-August.
Withholding paid money from teachers' salaries is against the law
According to Article 269 of the Labor Code, overpaid wages cannot be recovered from an employee (including in cases of incorrect application of labor legislation or other legal acts on labor).
In addition, according to Article 1030 of the Civil Code, wages and equivalent payments, pensions, benefits, scholarships, compensation for damage to life or health, alimony and other monetary funds provided to a citizen as means of subsistence are not returned as unjustified gain if he does not commit dishonesty and there are no errors in calculation.
That is, even if it is confirmed that paying teachers a bonus in June-August is a wrong practice, it is impossible to return the excess bonus paid to teachers. That is, it is illegal for accountants to withhold the paid bonus from the monthly salary of teaching staff.
At the same time, the editorial office of xalqtaliminfo.uz appealed to the Republican Council of the Trade Union of Education and Science Workers of Uzbekistan regarding the situation. The Republican Council said that it would study the situation in detail and provide additional details in the near future.
