In 2024, a citizen working as a teacher in one of the schools of the Sergeli district of the city of Tashkent contracted an occupational disease and applied to the Federation of Trade Unions of Uzbekistan based on the certificate No. 476588 dated April 2, 2024, of the Medical and Social Expert Commission (MSEC) of the Sergeli district of the city of Tashkent of the National Agency for Social Protection under the President of the Republic of Uzbekistan.

It is known that the third group of disability of a pedagogical worker due to an occupational disease is established, the level of loss of professional work capacity is 40 percent, the level of loss of professional work capacity is until April 30, 2025, and the date of re-examination is April 2, 2025. The appeal was reviewed by specialists of the Republican Council of the Trade Union of Education and Science Workers of Uzbekistan. As a result of the inspection, it was established that since April 2024, monthly payments for compensation for harm caused to the health of a teacher due to an occupational disease in the amount of 40% of the average monthly salary have not been paid until January 2025, and since January, they have been paid incorrectly, and the Sergeli District Department of Preschool and School Education has not paid the lump-sum compensation.


As is known, Article 321 of the Labor Code of the Republic of Uzbekistan (Labor Code) states: "The employer is obliged to compensate the employee for harm caused to his life or health by an occupational injury and (or) occupational disease," while Article 324 states: "The amount of monthly payments made to compensate for lost wages in connection with harm to the employee's health is determined as a percentage of the average monthly earnings received by the victim before the occupational injury, corresponding to the degree of loss of professional work capacity."


The degree of loss of professional work capacity is determined by the medical and social expert commission." Article 323 states: "The amount of a lump-sum allowance paid by the employer in connection with harm to the employee's health is determined by the collective agreement, and if it is not concluded, by agreement between the employer and the trade union committee. In this case, the amount of the lump-sum allowance paid in connection with causing harm to the health of the employee should not be less than the annual earnings of the injured employee, calculated on the basis of the average monthly earnings."


Based on the above legal requirement, on December 5, 2024, the Republican Council of the Trade Union of Education and Science Workers of Uzbekistan, in accordance with Articles 534-540 of the Labor Code of the Republic of Uzbekistan and the Law of the Republic of Uzbekistan "On Trade Unions," issued a relevant Instruction to the employer.


However, the employer did not fulfill the requirements of the directive in a timely manner. After that, specialists of the Republican Council filed a lawsuit in the interests of the employee in the Sergeli Inter-District Court for Civil Cases of the city of Tashkent.


As a result, according to the court decision of March 25, 2025, the claim was partially satisfied. According to the document, 19,275,204 soums in damages, 48,188,011 soums in lump-sum benefits, 268,706,187 soums in compensation for late payments, 1 million soums in moral damages, and 37,500 soums in postal expenses were recovered from the responsible Sergeli District Department of Preschool and School Education.


In total, 337 million 206 thousand 902 soums were recovered from a teacher who suffered an occupational disease and whose labor rights were violated.
