Teachers who disagree with the results of the certification can appeal to the court.

As is known, according to the Regulation "On the Procedure for Certification of Teaching Staff of Preschool, General Secondary, Secondary Specialized, Vocational, and Extracurricular Educational Organizations," approved by Resolution No. 572 of the Cabinet of Ministers dated September 17, 2021, teaching staff dissatisfied with the results of the certification can submit a written application (complaint) to the Appeals Commission within ten days from the date of publication of the results.
It turned out that the appeal commission sends almost identical responses to the complaints of teachers who are dissatisfied with the results of the certification.
For example, a teacher who was dissatisfied with the qualification tests in the subject of native language and literature and filed a complaint was sent a general response in the following form:
"Your objection regarding the results of the test conducted on April 22, 2025, to assess the knowledge of teaching staff in the subject of native language and literature was reviewed by experts, and it was determined that the questions were structured within the framework of the subject, without deviating from the provided specifications and literature, there were no errors in the questions and answers, and your objection was deemed unfounded.
Here we remind you that you were provided with a specification that fully covers the test questions. We wish you good luck in the next certification process!," the appeals committee said in its response.
That is, in the response given by the appeals commission, general words were used: "questions are structured within the framework of the subject," "no errors," "no objections" - but no specific evidence, examples, or expert opinions supporting these opinions were attached.
There is also no information about which questions the teacher objected to in the complaint and how they were considered. Also, in the response to the complaint, the phrase "you were provided with a specification that fully covered the test questions" was used.
In reality, the presence of a specification does not guarantee that the questions are 100 percent correctly formulated. The test questions may contain ambiguous expressions, confusion, and controversial answer options, and these cases should have been considered separately by experts.
This answer is written in the form of a template, which can be sent to any teacher. This indicates that the appeal of the pedagogical staff who filed the complaint has not been fully studied.
Have teachers been invited to the complaint review process?
Clause 58 of the Regulation stipulates that applicant pedagogical staff can participate directly or remotely online in the process of reviewing their appeal by the appeals commission.
However, the pedagogical staff who filed the complaint most likely did not participate in the process of reviewing their appeal, and they were only sent a response from their personal account.
What should those dissatisfied with the decision of the appeals committee do?
Currently, there is no organization that checks the validity of tests in the certification of pedagogical personnel, compiled on the basis of the order of the Ministry of Preschool and School Education, and gives a conclusion.
Therefore, complaints from pedagogical staff are also reviewed by responsible employees working within the Ministry's system. This, in turn, may reduce the likelihood of impartial consideration of appeals submitted based on the results of the certification.
Therefore, in such cases, teachers who are dissatisfied with the results of the certification must appeal to the court. As is known, according to paragraph 61 of the regulation, pedagogical staff can appeal the decision of the appeals commission to the court in the manner prescribed by law.
