Will the employee be compensated for each day of delay if the vacation fee is late?
If you take an annual leave from June 1, 2024 (Saturday), the amount of the leave must be deducted by May 31, 2024 (Friday). If it does not fall, then the legislation is being violated. In this case, according to Article 333 of the Labor Code, the employer is obliged to pay monetary compensation in case of violation of the period of payment of leave payments.
Many people misinterpret the idea that the employer must pay compensation, and ask why the employer should pay compensation if the employer is a school principal and the director is not responsible for the delay in the vacation.
Note that according to Article 19 of the Labor Code, the employer is not a director, but a school. That is, the director pays the monetary compensation not from his pocket, but at the expense of the school (state budget).
Based on the requirements of Article 333 of the Labor Code, if the amount of the employee's leave payment is 6 million soums, which is due to be paid for 10 days, the following shall be calculated for each day of delay:
1.4 percent of 6 million soums will be 84 thousand soums.
Here, 1.4 percent is 14 percent of today's refinancing rate of the Central Bank of the Republic of Uzbekistan, and 10 percent is received in accordance with the requirement of Article 333 of the Labor Code.
Accordingly, the employer must pay the employee compensation in the amount of 840,000 soums for ten days.
In case of non-payment of this monetary compensation to the employee, it is possible to apply to the territorial labor inspection or inter-district court.
