According to Article 227 of the Labor Code, annual labor leave is provided to the teaching staff of educational organizations during the summer leave of students for the full duration of the annual labor leave of the first working year during the summer leave of students, regardless of the time they entered this educational organization, paid in proportion to the time they worked.
Labor leave for this category of employees for the second and subsequent working years is paid in full, regardless of when this leave is given during the working year.
That is, let's say that the employee entered work in September and went on leave in June, where the employee is given a full 56 calendar days of leave, but the amount of the leave is paid in proportion to the time he worked, that is, for 9 months.
In this case, 56/12 = 4,666. 4,666*9=42 holidays. However, in accordance with the "Norms of the duration of annual extended leave for teachers" approved by the Resolution of the Cabinet of Ministers No. 263 dated June 26, 2023, working days are paid when calculating the amount of leave.
Now let's divide the above 42 days by 7. Because there are 7 days in a week. 42/7=6. Why is it divisible by 6? Because Sunday has been removed. After that, 6*6=36 days leave.
So, employees who get a job in September will be given 56 calendar days of work, but 36 days of holidays will be paid.
