Hello. I am a teacher of CHQBT. Do the National Guard officers attached to the school have the right to interfere with the work activities and uniforms of the teachers? I don't wear a military uniform on days I don't have classes, but I wear them on days I have classes. They came on the day I didn't have classes and demanded a uniform from me and issued a report on me. Is this legal?

ANSWER

On February 26, 2024, the Ministry of Preschool and School Education and the National Guard signed a joint resolution No. 4-k/k and 5-k/k.

In the concept of cooperation approved by this joint decision, the main tasks of the National Guard employee, inspector psychologists attached to educational institutions are defined.

In the concept of cooperation, the National Guard officer, inspector psychologists are not given any authority to interfere in the internal affairs of the educational institution, to interfere in the processes of school teachers and employees coming and going to work or other labor obligations.

In accordance with the joint decision signed between the Ministry of Preschool and School Education and the National Guard, the job duties of inspector psychologists are defined as follows:

An employee of the National Guard conveys information about students who are absent from school without reason to the "Neighborhood Seven" and working groups organized in the neighborhood;

"Neighborhood Seven" and the National Guard employee go to the address of residence of students who missed classes without reason, conduct a preventive conversation with parents and take measures to return the child to class;

if necessary, take administrative measures against parents who have prevented their child's education and have not fulfilled their obligations;

every week "Makhalla Yettiligi" and the National Guard employee will inform the coordinating staff and the school administration about the measures taken to return students to classes;

every Thursday of the week, as part of the "Prevention Day", an "Attendance" event was held to identify students working in the trade and service sectors during the lesson, involving the inspector-psychologist and representatives of the "Neighborhood Seven" and internal affairs bodies. will go;

the inspector-psychologist participates in parent meetings held in schools and discusses with parents issues related to their children's education, behavior, internal order and compliance with the rules of etiquette;

the school psychologist and the inspector-psychologist jointly carry out targeted psychological work aimed at forming immunity among students against violations of the law and other forms of behavior.

According to Article 5 of the Law on the status of a pedagogue, it is forbidden to interfere in the professional activity of a pedagogue, to check his activity without reason.

The processes of school teachers and employees in the system of the Ministry of Preschool and School Education coming to and from work or fulfilling other labor obligations are regulated by the Ministry and its regional units.
