Problems arise in the regions after the changes in the requirements for class teachers by the order of the Minister of Preschool and School Education, signed 8 days before the start of the new academic year in educational institutions.


The fact is that on August 25, 2025, in accordance with Appendix No. 5 to the Ministry's Order No. 308 "Amendments to Certain Orders of the Minister of Preschool and School Education," additions and amendments were made to the Ministry's Order No. 190 of June 27, 2023, "On Approving the Job Instructions of the Deputy Director for Spiritual and Educational Work of a General Secondary Educational Institution and Class Teachers."


According to it, class teachers were required to have a higher pedagogical education. That is, it is forbidden to give classroom management to teachers with secondary specialized education.


It is known to many that until now, classroom management has also been entrusted to teachers with secondary specialized education in primary grades, and in the employment contract concluded with them, it is recorded as "Elementary School Teacher." In this case, classroom management in primary grades is entrusted to teachers of native language, reading, and mathematics.


Because, in the "Qualification Characteristics of the Main Positions of Managers and Employees of a General Secondary School (School-Boarding School)," approved by Order No. 159 of the Minister of Preschool and School Education dated May 16, 2025, it is indicated that at least a secondary specialized pedagogical education in the specialty of primary education is sufficient for a primary school teacher.


Also, in paragraph 6 of the Resolution of the Cabinet of Ministers No. 275 of December 21, 2005, and in paragraph 4 of Appendix No. 3 to the Resolution, there is also a mention of teachers with secondary specialized education, and there is no norm stating that this category of teachers does not work in an educational institution.


Clause 15, paragraph 19 of the Regulation "On the Procedure for Completing Classes and Forming Tariff Lists in General Education Institutions" (registration number 3271) also indicates that teachers with secondary specialized, professional education may work in an educational institution before being provided with teachers with higher education.


However, as noted above, by order of the Minister No. 308, teachers with secondary specialized education were prohibited from leading classes. However, the Ministry did not make changes to the qualification requirements for teachers, which are the main document for hiring teachers, and did not take into account or bring into compliance with the norms provided for in other legislative acts when developing this order.


In fact, even if this order were recognized as justified, the requirements did not apply to primary school teachers with secondary specialized education, and this norm should have come into force from the next academic year. Or it was necessary to study in detail whether the employment contract concluded with teachers with secondary specialized education was drawn up in accordance with the requirements of the legislation, and to act according to the results of the analysis.


Because, according to Article 41 of the Law on Normative Legal Acts, normative legal acts do not have retroactive effect and are applied to social relations that arose after their entry into force.


That is, teachers with secondary specialized education, who were class teachers before the Ministry's order, could continue their activities in the 2025-2026 academic year.


However, due to the fact that the Ministry signed this order only 8 days before the new academic year and did not post it on its official page, and did not give a full understanding of the essence of this order, at the same time, work has begun on the dismissal of teachers working in some educational institutions.


Because it seems that this order signed by the minister has not been thoroughly analyzed in advance what legal consequences it can have in the lower system.


Teachers told xalqtaliminfo.uz that they are being asked not only to dismiss them, but also to return to the state budget the payments made for class management in September.


Indeed, it is natural that Ministry Order No. 308 creates many problems related to class teachers. In our opinion, the ministry should have previously determined the contingent of teachers with secondary specialized education working in educational institutions and formed a reserve for the vacant class leadership position.


If the Ministry does not abolish the norms provided for in Appendix No. 5 to Order No. 308 or harmonize them with other legislative acts, it is natural that this problem will worsen in the future.


We await an official response from the Ministry of Preschool and School Education regarding this situation.
