According to paragraph 6 of the decision of the Cabinet of Ministers No. 572 dated September 17, 2021, pedagogic personnel who have reached the retirement age will not be involved in the next attestation, regardless of the expiration of the attestation period, their current qualification category (position) will be preserved and they are paid according to this qualification category (position).
In this case, the pedagogic personnel who have reached the retirement age will be paid according to the newly approved qualification category (position) if they pass extraordinary attestation and their qualification category (position) is increased.
According to this rule, it is not possible to attract and force retired teaching staff to mandatory attestation.
In such situations, in accordance with Article 49 of the Code of Administrative Responsibility against the employer (i.e. violation of labor and labor protection legislation by an official), a fine in the amount of 5 to 10 times the base calculation amount is imposed. cause.
