Currently, the involvement of teaching staff in professional development courses is regulated by the Regulation "On the procedure for organizing continuous professional development of employees of preschool and school educational organizations," approved by the Resolution of the Cabinet of Ministers No. 867 of December 20, 2024.
The rights and obligations of teachers involved in professional development are defined in the Labor Code.
According to Part 3 of Article 367 of the Labor Code, professional development is understood as improving the level of professional knowledge, skills, and abilities of an employee, characterizing their readiness to perform work in their current profession and specialty.
According to Article 370 of the Labor Code, if an employee is sent to retraining or advanced training, which is mandatory for the employer and the employee, the employer is obliged to keep the employee's place of work (position) and average salary during the period of retraining or advanced training.
If retraining or advanced training is carried out voluntarily, the employer is obliged to keep the employee's place of work (position) during retraining or advanced training.
The issue of maintaining the average salary of an employee is resolved in a collective agreement, an internal document adopted by the employer in agreement with the trade union committee, or by agreement of the parties to the labor contract.
According to Article 290 of the Labor Code, if the employee's professional training, retraining, advanced training and internship require relocation to another place on the employer's referral, the employee must also be reimbursed for travel to and from the place of study, as well as for renting housing.
Employees sent to vocational training, retraining, advanced training and internships may be paid compensation (per diem) for living outside their place of residence in a collective agreement or an internal document approved by the employer in agreement with the trade union committee.
Therefore, the conclusion is that when a teacher is involved in professional development courses, the employee's place of work (position) and average salary are preserved. If the advanced training requires relocation, the employee will also be reimbursed for travel to and from the place of study, as well as for renting housing.
